Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and [COMPANY LEGAL NAME] ("VibeVideo", "we", "us"). By creating an account or using the service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

You must be at least [18] years old to use VibeVideo. The service is not directed to children, and we do not knowingly allow accounts for anyone under that age. By using it, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

VibeVideo lets you generate images and videos from your prompts and the photos you upload, using third-party AI models, and — if you choose — to share creations to a public feed where others can view and remix them. Features may change, and we may add, modify, or discontinue parts of the service.

Keep your login credentials secure; you are responsible for activity under your account. Provide accurate information and notify us of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

You keep ownership of the photos you upload, and of the content you create (to the extent it is protectable, and subject to the underlying AI providers' terms). You grant us the limited, non-exclusive rights needed to host, process, and transmit your uploads, produce your output, and store and display your content back to you. We do not claim ownership of your content.

Your creations are private by default. If you choose to make one public, you grant us and other users a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that creation, to allow other users to view and create remixes/derivatives from it, and to feature it to promote VibeVideo — for as long as it remains public. Making it private or deleting it ends that license going forward, though copies or remixes others already made may persist. We never make your content public without your choice.

You may only upload photos that are of you, or that you have the rights and permission to use, including the consent of any identifiable people shown. You are responsible for obtaining that consent. Do not upload images of other people — including public figures — to create content without their permission. You are solely responsible for content you create and how you use it.

You agree not to use VibeVideo to create, upload, or share content that:

• is unlawful, infringing, or violates anyone's privacy, publicity, or intellectual-property rights;
• depicts a real, identifiable person without their consent — including deceptive deepfakes, impersonation, or sexualized depictions;
• is sexual content involving minors, or any content that sexualizes, endangers, or exploits children (zero tolerance — reported as required by law);
• is harassing, hateful, threatening, defamatory, or promotes violence or self-harm;
• is deceptive, fraudulent, or impersonates a person or organization;
• contains malware, or attempts to scrape, reverse-engineer, overload, or circumvent limits or security of the service.

We may remove content and suspend or terminate accounts that break these rules, and may report unlawful content to authorities.

Output is generated by AI and may be inaccurate, unexpected, or imperfect, and similar prompts may produce content for different users. You are responsible for reviewing output and for how you use it, including complying with the AI-content disclosure rules of any platform where you post it (e.g., TikTok, Instagram). We may apply provenance signals, labels, or watermarks to generated content.

Generation consumes credits. Pricing and credit terms are shown in the app and may change. Credits are not redeemable for cash and are non-transferable. Failed generations are handled per the in-app messaging. Except where required by law, payments are non-refundable.

The VibeVideo app, brand, templates, and software are owned by us or our licensors and are protected by law. We grant you a limited, revocable, non-transferable license to use the service for its intended purpose. You may not copy, resell, or create competing services from it.

Generation is performed by third-party AI providers (including RelayGPU/OpenGPU and the underlying model providers). Your prompts and uploads are transmitted to the provider that fulfils your request, solely to produce your output. Your use may also be subject to those providers' terms and acceptable-use policies.

We may, but are not obligated to, review content. You can report content that violates these Terms through the in-app reporting tools or by contacting us. We may remove content, restrict features, and terminate repeat infringers. If you believe content infringes your rights (including copyright or your likeness), contact us at [CONTACT EMAIL] with the details.

You may stop using the service and delete your account at any time. We may suspend or terminate your access for violations of these Terms or to comply with law. On termination, your right to use the service ends; certain provisions (ownership, licenses for already-shared content, disclaimers, limitations, and indemnities) survive.

The service and all output are provided "as is" and "as available," without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that output will meet your expectations.

To the maximum extent permitted by law, VibeVideo and its providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the [12] months before the claim or [USD amount]. Some jurisdictions do not allow these limits, so they may not fully apply to you.

You agree to indemnify and hold harmless VibeVideo and its providers from claims, damages, and costs arising from the content you upload, create, or share, your use of the service, or your violation of these Terms or the rights of others (including consent, likeness, and intellectual-property claims).
